NO PURCHASE NECESSARY TO ENTER OR WIN. COMPLETION OF REGISTRATION AND PROMOTION DOCUMENTATION REQUIRED TO PARTICIPATE. 

SPONSOR:  The Linux Foundation, 2810 N Church St. PMB 57274, Wilmington, Delaware 19802 (“Sponsor”).

By participating in this Promotion, all eligible individuals and team members shall be collectively referred to as “Participant(s)”. By participating, Participants agree to be bound by: these Linux Foundation “OpenSearch Agent Skills Hackathon” Official Rules (“Official Rules”), any other required documentation required, all related instructions, information and communications (collectively “Promotion Documents”) from the Sponsor and the Judges and their respective authorized representatives (collectively the “Promotion Entities”), and the decisions of the Sponsor which are final and binding in all respects. Participants expressly represent and warrant that they are participating as an individual, and not by or on behalf of any third party company, employer or entity, or in any outside commercial, paid or salaried capacity. 

ARBITRATION NOTICE: BY ENTERING, YOU AGREE THAT DISPUTES BETWEEN YOU AND ANY PROMOTION ENTITY ARISING OR RELATING TO THE PROMOTION AND ANY ELEMENT THEREOF WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A JURY TRIAL, CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. See Disputes/Arbitration provision. 

DESCRIPTION OF EVENT: This is a trade promotion consisting of a skill-based contest offered to eligible individuals in the tech field (such as, without limitation, Solution Architects, TAMs, ProServe Consultants, CSMs, Cloud Support Engineers, Engineers, the broader TFC community, etc.) who come together to create pre-built agentic IDE skills covering search, log/observability, and migration on the open source OpenSearch Project (“Promotion”). Participation requires registration and prior confirmation of selection and eligibility to participate by Sponsor. Eligible Participants may work individually or as a team, which can be composed      of two (2) eligible Participants. Participants will submit a 5-minute video showcasing their agentic solution, production-ready code, and a clear README document in support thereof (“Entry”). Entries will be judged by a neutral panel of subject matter experts selected by Sponsor (“Judges”). Each Entry will be assessed, judged and scored in accordance with the judging criteria herein to select one (1) potential Grand Prize winner, one (1) potential First Prize winner and one (1) potential Second Prize winner based on the highest scores received respectively. Grand Prize will consist of a monetary award and may also include an opportunity for the Grand Prize winner to present their solution during the OpenSearchCon NA Event in September 2026 (“Event”). Prior to participation in the Promotion, all Participants will be required to timely register, agree to these Official Rules and sign and return all Promotion Documents to Sponsor’s satisfaction or will be ineligible to participate. Participants may not use the Promotion to market any goods or services.

ELIGIBILITY: Participants must be individuals who are legal United States residents 18 years or older who are in the tech field, have registered and fully executed all documentation and complied with all prerequisites of Sponsor to participate in this Promotion, and are not ineligible or under any conflicting employment, contractual, legal or other restriction to participate in Promotions of this nature or win a prize (as applicable) (eligible “Participant(s)”). 

INELIGIBILITY: Employees, officers, and directors of the Sponsor, any Promotion Entities, any individuals or entities involved in the production, administration and/or execution of this Promotion, and their immediate family members (spouses and parents, partners, children and siblings and their spouses, including foster and step-relations) and members of the same households (whether related or not) of any of the aforementioned are ineligible to Enter, participate in the Promotion or contribute to an Entry. 

THIS PROMOTION IS VOID TO: Persons who are participating other than as an individual (or Team of 2 individuals) in their own right (such as without limitation, in a paid or unpaid capacity for, by, or on behalf of any company, business, or any other third party entity); persons subject to U.S. government sanctions; persons who are citizens of or residing in a U.S. embargoed jurisdiction (including Cuba, Iran, North Korea, Syria, and the Crimea region of Ukraine; Russia and Belarus     ), or persons whose work may be subject to U.S. export controls/sanctions. 

IMPORTANT NOTICE: Participants have the responsibility to review and understand their employer’s and/or country’s policies, laws, rules and/or regulations, tax implications, and any other limitations (collectively “Policies/Laws”) regarding eligibility to participate as an individual in contests of this nature and/or receive a prize, as applicable. If a Participant is in violation of any Policies/Laws, Sponsor may disqualify the Participant and forfeit their prize, or require immediate prize return, if applicable. 

PROMOTION PERIODS: The Promotion begins on or about 8:00 am Pacific Time (“PT”) on July 15, 2026 and ends approximately 11:59 pm on August 16, 2026 (the “Promotion Period”). It is anticipated but not guaranteed that Entries will be judged between August 17, 2026 and August 30, 2026 (“Judging Period”), and winners announced on or about Sept 3, 2026. All dates and times are approximations and may be subject to change; times may be shortened or extended due to exigent circumstances or as deemed necessary by Sponsor. All time is Pacific Time. The Sponsor’s clock shall be the official time-keeping device for the Promotion. 

Sponsor reserves the right, without notice or prior approval, to modify or supersede these Official Rules in its reasonable discretion and in such event will post revised Official Rules on the Website, which will continue to govern all aspects of the Promotion. The Promotion is at the discretion of the Sponsor, and may be cancelled, postponed, modified or terminated without notice due to exigent circumstances in Sponsor’s sole and absolute discretion, without liability of any kind.

ENTRY REQUIREMENTS: Entries accepted during the Promotion Period, after registration and confirmation of selection and eligibility to participate. To enter, eligible Participants go to https://github.com/opensearch-project/opensearch-agent-skills/issues/new?template=hackathon_submission.yaml, accurately and fully complete all required information including agreeing to these Official Rules, and submit: (i) an OpenSearch related production-ready code that focuses or tackles one of the agentic skills referenced below, (ii) one (1) video (up to 5 minutes long) that clearly showcases the solution, and (iii) a README document that provides a brief summary of what the tool does, agentic skill addressed, and/or or what the dataset represents. Some examples entries could tackle at least one of the following agentic skills areas:

  • Solving new OpenSearch use-cases that were difficult before without agents
  • Improving user productivity
  • Solving customer pain points
  • Simplifying operations with OpenSearch

For purposes of the Promotion and pursuant to these Official Rules, unless otherwise specified, the Entry, and all content, materials and information submitted in any and all media and medium by an eligible Participant, including all of its members, during the Promotion, will collectively constitute the “Entry”. Without limiting any other provision, Entries must be in English, compliant with the Apache 2.0 license and OpenSearch’s principles, capable of being integrated within Open Search, available free of charge and without any restriction, for testing, evaluation, and use by the Promotion Entities; and must not contain any code that has any current or future monetary, proprietary, or licensed external dependencies, include any materials that would restrict or limit any reciprocal open source licenses or other terms that limit the disclosure, licensing, or distribution of source code or other proprietary materials, or incorporate any data, content, or materials that Participant does not have the right to use, submit, and disclose in connection with the Promotion. All the above shall be determined by Sponsor in its absolute discretion. Intellectual property included or embodied in an Entry and all content therein is open-source, can be used by Open-source community or enterprises, for example, to enhance their products.

The same Entry may not be submitted by multiple Participants. Participants may submit multiple Entries, provided each Entry addresses an entirely different, separate and discrete use-case or solution than any other Entry submitted by the same Participant (as determined by Sponsor). A Participant may only join one (1) Team – a team is defined as two individuals, but may also participate as an individual contributor, provided their Entries comply with the above. As determined in Sponsor’s sole discretion, in whole or in part unsuccessful, exploitational, fraudulent, misleading, harmful, non-functioning, invalid, irrelevant, non-compliant, nonsensical, seemingly plagiarized, forged, copied or invalidly automated, or incomplete Entries in whole or in part or those not deemed to be submitted in good faith may be disqualified. Submission of Entry is not proof or evidence that the Entry and/or Participant is eligible or compliant. Participants who quit, are disqualified, ejected or otherwise fail to complete the Promotion or any part thereof will not be eligible to win a prize in the Promotion. 

Further, by entering this Promotion, Participants hereby represent, warrant and covenant (as applicable), and agree to produce written evidence of such if requested, that:

(i)              The Entry must be the Participant’s own work, built under their active direction and representing their original concept. AI-assisted development is fully permitted, including the use of AI coding tools to build, iterate, or debug the Entry. The Entry must not replicate an existing submission to this Promotion or reproduce a skill already present in the OpenSearch Agent Skills repository at the time of submission. Automated or deceptive participation methods are not permitted. The Entry must comply with all applicable laws, Promotion Documents, and third-party rights.

(ii)             The Entry, in whole and in part, is submitted to the Promotion by or with the permission of all persons (living or deceased), venues and/or business entities who appear, worked on, were engaged to work on, or contributed in any respect to the Entry or any part thereof, who are depicted (directly or indirectly) in the Entry by name, likeness, voice, image or any other information or indicia of persona, or who otherwise have any right, title or interest in and to the Entry or any part thereof (including but not limited to rights arising from employment or work for hire relationship), and all such persons, venues, and/or business entities have provided their consent to submission of the Entry and its use pursuant to these Official Rules; 

(iii)             Participant has all  rights, licenses, permissions and consents necessary to submit the Entry and to grant the rights granted to the Promotion Entities in these Official Rules, and the exercise of such rights by the Promotion Entities and/or their use of the Entry does not and will not give rise to any claims, disputes, actions, or liabilities, including without limitation, claims for intellectual property rights, payment of any kind (such as royalties, residuals, attribution, credit, dues, moral rights, approval or consultation rights, or participation rights), attribution, or any other fees, costs, or expenses, arising from the submission, use, exhibition,  or exploitation of the Entry, or from  the exercise of any of the rights granted in these Official Rules;

(iv)            The Entry, in whole or in part, contains no deepfakes, malware, including viruses, trojans, worms, bugs, spyware or any other prohibited or harmful software, code or devices; and

(v)             The Entry, in whole or in part, does not contain, appear to condone or promote content or activities such as drugs, gambling, over-consumption, pornography, nudity, sexual exploitation, or that are defamatory, offensive, violent, harmful, unsafe, dangerous, illegal, discriminatory, cruel, abusive, highly political, religious or sensitive content or activities (including but not limited to technology or other content that is prohibited from export), or content of an obscene or menacing character, or any other content that offends against reasonable standards of taste and decency (all as determined by Sponsor in its absolute discretion).

 

GENERAL ENTRY CONDITIONS: For purposes of this Promotion, an Entry may not be cancelled, enhanced, added to, or improved once submitted. Entries may be publicly displayed, viewed and used by the Promotion Entities in whole or in part, as provided herein and by others interested in, involved with, or administering the Promotion, and by all other Participants in the Promotion. Participants assume all risk of ineligible, compromised, lost, late, incomplete, invalid, incorrect, incompatible, non-functioning, or misdirected Entries, in whole or in part. PROMOTION ENTITIES MAKE NO WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN CONNECTION WITH THEIR ABILITY AT ANY TIME OR IN ANY WAY TO ENABLE, DEVELOP, MARKET OR PROMOTE THE PARTICIPANT, THE ENTRY, NOR THE PRODUCTS, GOODS/SERVICES, IDEAS OR TECHNOLOGY EMBODIED OR SET FORTH IN THE ENTRY, IN WHOLE OR IN PART.  

A Participant may not switch Teams once an Entry has been submitted. Participants affirmatively agree to work in a spirit of mutual collaboration and professional, respectful, and inclusive behavior for all Promotion Entities, Participants and their Team members or may be subject to immediate disqualification. Promotion Entities reserve the right to disqualify any Participant, which may affect to the applicable Entry of their Team member, due to an individual’s failure to comply and/or inappropriate behavior (as determined by Sponsor in its absolute discretion). As applicable, a prize will be awarded to a winning Team as a whole, and the respective prize must be divided equally amongst all applicable Participant Team members. In the event a Team member is disqualified, refuses, or forfeits the opportunity to continue in the Promotion, receive a prize in the Promotion, or is otherwise unable or unwilling to participate or accept a prize (as applicable), it will be in Sponsor’s absolute reasonable discretion (based on, for example, the reason for disqualification and egregiousness of actions) as to whether the potentially winning remaining Participant may still be awarded the prize or whether the Team as a whole should be disqualified. In this case, the prize will be forfeited and an alternate potential winner may be selected (in Sponsor’s discretion) based on score, only if deemed feasible and equitable. 

Without limitation, Sponsor reserves the right to immediately disqualify and/or remove at any time (before, during or after the Promotion) any Entry and/or Participant for any reason in its absolute discretion. Without limiting the foregoing, if at any time a Participant and/or winner is found to have breached, violated or failed to comply with these Official Rules (or any other Promotion Documents or other agreement), in whole or in part, at any time, or if they are found at any time to have been ineligible they will be immediately disqualified and must immediately return in full any and all prize (if applicable). Without limiting any other right or term herein, a Participant may be disqualified at any time from the Promotion immediately if, in Sponsor’s (or its authorized representative’s) absolute discretion, it reasonably believes the Participant has, is suspected of, appears to, or has attempted to undermine the legitimate operation of the Promotion, is suspected at any time of engaging in artifice, cheating, plagiarism, deception, fraud, theft, using multiple or misleading identities or information, engaging in illegal, harmful, dangerous, unsportsmanlike activities or obnoxious behavior, or other unfair acts or practices, or has or attempts to annoy, abuse, threaten, harass, or intimidate or cause harm to any other Participant, any of the Promotion Entities or any other person, or if their actions may cause damage, destruction or loss of property.

Participants understand, recognize, and accept that, without fault of the Promotion Entities, other Participants may provide to one or more of the Promotion Entities, or others, or made public, or may in the future submit, or make public, materials that are the same or similar to Participant’s Entry. Further, Participants may independently access to, create or have created technologies, methods, materials, content or ideas that are similar or identical in whole or in part, to another Entry.  If an Entry is identical or similar to another Participant’s Entry, the Promotion Entities reserve the right subject to the judging criteria set forth herein, and the discretion of Sponsor and Judges to score one Entry higher than the other. Entries may not be acknowledged and will not be received or held “in confidence” or “in trust” and by submitting an Entry it does not create a confidential relationship or obligation of secrecy between the Participant and any Promotion Entity. Participants will not now or in the future be entitled to any approval, compensation, or other payment; unless adjudged and verified as a winner pursuant to these Official Rules, and, then only to the extent of the prize awarded. Further, Participants and winner agree that by submitting an Entry and/or receiving a prize in the Promotion does not create, and will not be deemed to create any express or implied, any employer/employee, joint or co-venture, principle/agent, or, fiduciary, or similar relationship, between them and a Promotion Entity, or any other person or entity. The Promotion Entities disclaim all responsibility and liability relating to all of the above, and Participants agree to the fullest extent permitted by applicable law to release, indemnify, defend and hold them harmless with respect to all related claims.

JUDGING CRITERIA/WINNER SELECTION: Eligible Entries submitted will be judged using the following Judging Criteria. Scores and reasoning for such scores will not be made public at any time.

25% Technical innovation

Does the skill use OpenSearch’s vector database or agentic capabilities in a novel way? Examples include advanced RAG patterns or multi-step reasoning.

25% Community creativity and utility

How innovative, original or resourceful is the use-case or the solution to which it can be applied?

How broadly can this skill be applied? Does it break down data silos or address common pain points for SREs, Search Engineers, or InfoSec Specialists?

20% Operational excellence

Is the code production-ready? Does it follow security best practices and deliver low-latency performance?

15% Vendor neutrality and portability

Is the skill free of proprietary dependencies? Does it run on any OpenSearch distribution, including self-managed, Docker, and Kubernetes?

15% Documentation and enablement

Is the README clear and actionable? Is there a 5-minute video that communicates value to a Tech Lead or CTO?

 

WINNER SELECTION: Assuming sufficient eligible Entries are received, it is anticipated that one (1) potential winning Participant will be selected based on their highest combined score in accordance with the above Judging Criteria (potential “Grand prize winner”), and one (1) potential First and one (1) potential Second prize winner will be selected based on the next highest scores respectively. Sponsor may, but without obligation, award more than the stated number of prizes if additional Entry/ies are found to be of exceptional quality in Sponsor’s and Judges absolute discretion. Sponsor reserves the right to select fewer than the stated number of prize winners due to insufficient eligible and qualified Entries/Participants. By way of example only, Sponsor reserves the absolute right in its absolute discretion to disqualify as ineligible, Entries that do not appear to create a credible or feasible solution to an agentic skill use-case capable of application with the OpenSearch      platform, appear not to have been submitted honestly, in good faith, or are otherwise lacking or non-compliant. Prize award is subject to verification of Participant’s eligibility and compliance. 

In the case of a tie, the tie will be broken (among the tied potential Entries) by the highest combined score(s) in the Technical Innovation category, and if a tie still remains the tie will be broken (among the remaining tied Entries) by the Entry with the highest score in the Community Utility category. PARTICIPANT IS NOT DEEMED A WINNER OR ELIGIBLE FOR THE PRIZE UNTIL VERIFIED AND CONFIRMED BY SPONSOR WHICH INCLUDES, AMONG OTHER THINGS, VERIFICATION AND FULL COMPLIANCE WITH THESE OFFICIAL RULES, ALL PRIZE AWARD AND PRIZE FULFILLMENT REQUIREMENTS. Potential Grand Prize winner will be required to complete, sign, have witnessed and return a Declaration of Eligibility, Liability, and where lawful, Publicity Release within the time stated by Sponsor, or else prize will be forfeited and an alternate potential winner may be selected based on next highest score from remaining eligible Entries, provided sufficient time exists prior to the Event.

PRIZES: Subject to receiving sufficient eligible Entries, and eligibility and compliance of potential winners, the following prizes are available to be awarded:

First Prize (1): one (1) USD$1,000 (awarded in the form of a check).

Second Prize (1): one (1) USD$500 (awarded in the form of a check).

Grand Prize (1): one (1) USD$1,500 (awarded in the form of a check). A 3 day/2 night trip to attend OpenSearchCon North America event in San Jose, CA on September 22 – 24, 2026 (“Trip”). Trip consists of roundtrip coach class air transportation to/from commercial airports near winner’s U.S. residence and San Jose, CA; ground transportation to/from San Jose hotel and airport; and two (2) nights’ hotel accommodations (single room, room and tax only). Trip has a maximum ARV of up to $2,000.  Grand Prize may also include an opportunity for Grand Prize winner to present their solution during the (as determined by Sponsor in its sole and absolute discretion) (promotional value only).

Trip Specifics: ANY COSTS, FEES AND EXPENSES NOT SPECIFICALLY STATED AS INCLUDED IN THE PRIZE, AND ANY UPGRADES, OVERAGES OR ADDITIONAL EXPENSES, ARE THE SOLE RESPONSIBILITY, COST AND EXPENSE OF WINNER AND WILL NOT BE ARRANGED OR PAID BY SPONSOR. Prize must be accepted as a whole or will be forfeited in its entirety. However, Sponsor will not award the Trip or opportunity if the event is cancelled or terminated, and in such case, the Grand Prize will solely consist of the USD$1,500 check. The minimum age to book elements of a trip prize package may be 25 years old. ARV of prize may vary but is limited to USD$2,000. Trip must be arranged through Sponsor’s representative and booked on or before the time specified by Sponsor or will be forfeited. Trip must be taken September 22 – 24, 2026, or Grand Prize will be forfeited in its entirety. Additional blackout dates and other restrictions may apply.  All trip arrangements must be made through Sponsor. In the event a winner lives within a 100-mile radius of prize location (as determined by Sponsor), ground transportation will be arranged or provided in lieu of air transportation. All aspects of the trip, including, but not limited to, specific airline(s), and flights are at the sole discretion of the Sponsor. Tickets are economy class, no upgrades permitted. Winner will be required to provide valid U.S. travel documents and to obtain and maintain all insurance (including travel, health, liability and any other insurance). Winner acknowledges and agrees that neither Sponsor nor Promotion Entities nor their authorized representatives are providers/carriers of transportation, or insurance providers. Extensions to expiration dates will not be granted. Trip package does not include travel to the departure airport, meals (except as specifically included), groceries, incidentals, tips, telephone calls, airline baggage fees, or any other fees, costs and expenses incurred during the winner’s stay. All airline tickets issued in conjunction with prize are not eligible for frequent flyer miles or any other promotional benefit, and any refund will inure solely to Sponsor’s benefit. No changes will be made to any element(s) of the trip once booked. Prize conditions may be added or modified by Sponsor. Sponsor is not responsible for any changes of any element of trip, nor are they liable for any expenses incurred as a consequence of flight changes, cancellation or delays, or any other issues not within its reasonable control. Any refunded, unclaimed and/or unused element of the prize, or any element thereof, will remain the property of Sponsor. The restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the Winner Declaration. Failure to timely provide required documents will cause prize to be forfeited and awarded to an alternate winner, provided sufficient time exists. In the event winner engage(s) in behavior that, as determined by Sponsor (or its designee) in their absolute discretion, is obnoxious or threatening, dangerous, harmful, illegal or that is intended to annoy, abuse, threaten or harass any other person or may cause property damage or loss, Sponsor reserves the right to terminate the trip early, in whole or in part, and to send the winner home with no further compensation, and no further prize fulfillment. 

Prizes awarded to an individual and not to a company or employer. Gift certificate, gift card, coupon or similar item received as a prize is for promotional purposes only and will not be replaced if lost, misplaced, damaged, destroyed or stolen; and is subject to the terms and conditions of issuer.

Select Entries (which may or may not be deemed prize winners) may be contributed to the official OpenSearch Agent Skills GitHub repository, giving Participant visibility across the global developer community (as determined by Sponsor).

These Official Rules shall control and serve to clarify any confusion, discrepancy, error or mistake communicated (at any time before, during, or after the Promotion or any part thereof) in any and all media/medium or by any person. Sponsor reserves the right to correct any such error, mistake, or typographical, printing, computer programming or operator error.  Sponsor further reserves the right not to award a prize to any Participant for any reason if doing so would not be in the spirit of the Promotion, or if it may adversely affect the reputation or goodwill of, or have a detrimental impact on Sponsor, any other Promotion Entity, this Promotion, or any of their respective products or services as determined by Sponsor in its absolute discretion. 

Limit one (1) Grand Prize per Participant. However the same Participant may be eligible to receive the Grand Prize for one Entry, and a First OR Second prize for a different Entry. All prize awards are contingent upon verification of potential winners and Entry, confirmation of their eligibility to receive a prize, and compliance with the Promotion Documents and prize award requirements. Prize winner must be able to accept the prize in its entirety or not at all, or else prize may be forfeited (in Sponsor’s absolute discretion). Prize is not assignable or transferable in whole or in part, and no prize substitutions allowed, in whole or in part, except Sponsor reserves the right to substitute a prize, or any part thereof, with a prize (or part thereof) of comparable value. In no event will Promotion Entities be responsible for awarding more than the stated value/number or denominations of prizes. PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TAXES: Winner is responsible for any local, state, federal/country or any other applicable taxes, compliance with (governmental) reporting, filing and documentation requirements, and for all other costs, expenses and fees connected with their acceptance and use of the prize in their respective jurisdictions. 

COMPLIANCE AND DISQUALIFICATION: In the event of disqualification for noncompliance, ineligibility, if a potential winner refuses or fails to complete and return release documents as directed on or within the time stated, or for any other reason is found after the fact to have been ineligible or noncompliant, that prize will be forfeited in its entirety and will not be re-awarded. Returned, undelivered, unclaimed, forfeited or un-awarded prizes will not be (re)awarded. Sponsor shall have the right, where necessary, to undertake all action and/or require further information as is reasonable to protect themselves against fraudulent or invalid claims, potential public scandal, ridicule, or disrepute in awarding the prize to any Participant.

INTELLECTUAL PROPERTY RIGHTS: As between Promotion Entities and the Participant, the Participant has and retains copyrights in and to the Entry that Participant had at time of submission of the Entry in the Promotion, but agree to grant an Apache 2.0 license to the community.

By participating,  whether or not determined a winner, Participants grant Sponsor and other Promotion Entities and their authorized representatives a non-exclusive, worldwide, royalty-free license to use, mention, commercially exploit, produce, reproduce, distribute, transmit, publish, publicly perform, publicly display, broadcast, exhibit and create a derivative work from (“Use”) their Entry and all content therein to review, evaluate, and analyze the Entry for Promotion purposes; display or discuss the Entry at any time during the Promotion and related activities; use excerpts or descriptions of the Entry in Promotion and related communications and presentations; and retain copies for recordkeeping, compliance, and internal evaluation. For clarity, the license to use the Entry includes the code, video, README document, and all demonstration, slides, decks and all ideas, concepts, information, statements, and Personal Attributes. This license does not permit modification or sublicensing and is solely for Entry evaluation, and for the execution and administration of this, and possible future promotions sponsored, hosted or affiliated with The Linux Foundation. 

PRIVACY: Promotion Entities and their affiliates and contractors may, wherever they do business, use, store and otherwise process personally identifiable information of the Participant in accordance with the Sponsor’s Privacy Policy (https://www.linuxfoundation.org/privacy/). By accepting these Official Rules, Participant is acknowledging that all information is provided voluntarily and doing so gives the Promotion Entities consent to collect, access, store and use the PII and Personal Attributes specified herein, all in accordance with these Official Rules, other Promotion Documents and the applicable Privacy Policy

PUBLICITY RELEASE:  In addition to the uses of PII specified in the Registration Documentation, these Rules, and the Sponsor’s Privacy Policy, Participants understand and agree (whether or not deemed a winner) that their name, image, likeness, voice, texts, posts, and any statements (provided they are legal and true) in whole or in part (collectively “Personal Attributes”) and their Entry and all elements thereof provided during the Promotion or at any other permitted time may be used and/or reused in any and all media at any time by Sponsor and/or one or more of the Promotion Entities and Participants grant to Sponsor and each such Promotion Entity and their authorized representatives the unrestricted, world-wide, royalty-free license to, or not to, use, re-use, mention, commercially exploit, produce, reproduce, distribute, transmit, publish, perform, display, broadcast, exhibit and create a derivative work from (which may be in  altered, combined, composite or condensed format) their Personal Attributes and Entry in any and all media now known or hereinafter developed (including but not limited to the Promotion Entities’ and (unrelated) third parties’ websites, digital and off-line social media, marketing and advertising properties) in support of the marketing, business, commercial and any other purposes of The Linux Foundation, the OpenSearch platform and/or agentic skills and affiliations therewith. Participants agree they have no right of inspection or approval, that no compensation will be given for the above license and rights, whether or not exercised, and agree not to assert any moral rights relating thereto.

RELEASE AND INDEMNIFICATION:  To the fullest extent permitted by applicable law, Participants and winner agree to release, indemnify, defend and hold harmless (“Release”) Sponsor and all other Promotion Entities, their parents, affiliates, subsidiaries and divisions, and their respective directors, officers, employees, contractors and agents (“Released Parties”) from and against any and all threatened or actual actions, liabilities, claims, demands, losses, settlements, fines, damages, costs and expenses (including reasonable attorneys’ fees) whether or not litigation is commenced (“Dispute”) arising at any time from participation in the Promotion (at any phase), the Entry and use or misuse thereof (in whole or in part), participation in Promotion and/or prize-related activities or inability to participate in the Promotion, activities or parts thereof, the delivery, acceptance, use, misuse of a prize or any failure with respect thereto, personal injuries, death, damage to or destruction of property, violation of the rights of intellectual property, publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, and any act, default, omission, non-compliance, and/or a violation or breach of any agreement, representation, warranty or covenant made herein, or any other agreements by/with Participant, the Promotion Entities, and/or any other third party or entity. 

Further, to the fullest extent permitted by applicable law, and without limiting the foregoing, Participants covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind these Releases. A waiver by one or more of the Promotion Entities of any term in these Official Rules does not constitute a waiver of any other provision. To the fullest extent permitted by applicable law, if any item or provision contained in these Official Rules or any part thereof is declared or becomes unenforceable, invalid or illegal for any reason it shall be stricken and all other terms and provisions of these Official Rules shall remain in full force and effect as if these Official Rules had been executed without the offending provision appearing therein. 

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED IN ANY WAY TO THIS PROMOTION.

NETWORKS AND CANCELLATION: Promotion Entities are not responsible for typographical error; technical, wi-fi, network, platform, computer, digital, telephone, cable, electronic, or hardware or software malfunctions, failures, connections, problems; incompatibility; unavailable, garbled, corrupt, or jumbled transmissions; service provider, Internet, wi-fi, platform, website, blog site, user net (in)accessibility, (un)availability or congestion; unauthorized human intervention or security breach; the unauthorized access to, alteration of Entries in whole or in part, the incorrect or inaccurate capture or processing of Entries, or other information, or the failure to process, collect or communicate any such information; electronic errors, omissions, interruptions, deletions, defects, and/or delays; or loss, theft or destruction of any Entry, or other Promotion related materials or information, in whole or in part.  If for any reason the Promotion, or any part thereof, is not capable of running as planned for any reason, including (but not limited to) infection by computer virus, bugs, tampering, unauthorized intervention, artifice, fraud, cheating, technical failures, a force majeure event, or any other causes similar or dissimilar which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, or any element thereof, Sponsor reserves the right in its absolute discretion to cancel, terminate, modify or suspend the Promotion or any part thereof. Promotion Entities reserve the right to select only potential winners from eligible, non-suspect Entries received (prior to the aforementioned event or otherwise), but only if doing so is deemed practicable and equitable in their determination under the circumstances. Any attempt by a Participant to deliberately damage or undermine the legitimate operation of the Promotion, or any part thereof, is a violation of law and should such an attempt be made, Sponsor reserves the right to disqualify Participant and seek damages from any such Participant to the fullest extent of the law.

DISPUTES/ARBITRATION:  Sponsor’s decisions are final and binding in all matters and Disputes relating to this Promotion, including, but not limited to, interpretation and application of these Official Rules. For greater certainty, such matters and disputes are to be resolved in Sponsor’s sole discretion.  PARTICIPANTS AGREE THIS PROMOTION IS GOVERNED BY THE LAWS OF DELAWARE WITHOUT REGARD TO CONFLICT OF LAWS OR CHOICE OF LAW DOCTRINES. As a condition of participating in this Promotion, Entrants agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action, exclusively before a neutral one-person arbitration panel located in Wilmington, DE.
